about the State Automobile Inspection Department
Ministry of Internal Affairs of the Republic of Tajikistan

I. General provisions

1. The Department of State Vehicle Inspection of the Ministry of Internal Affairs of the Republic of Tajikistan (hereinafter referred to as the Department of Motor Vehicles) is a separate unit of the central apparatus of the Ministry of Internal Affairs of the Republic of Tajikistan and carries out special monitoring, supervision, authorization and ordering activities in the field of ensuring road traffic safety.

2. The State Automobile Inspection Department in its activity is governed by the Constitution of the Republic of Tajikistan, the laws of the Republic of Tajikistan "On Police", "On Road Traffic", the Decree of the Government of the Republic of Tajikistan "On Approval of the Regulation of the State Vehicle Inspection of the Ministry of Internal Affairs of the Republic of Tajikistan, decrees and orders The President of the Republic of Tajikistan, the decisions and orders of the Government of the Republic of Tajikistan, this Regulation, as well as the international legal documents recognized by the Republic of Tajikistan, act as guidelines.

3. The State Automobile Inspection Department works in mutual cooperation with other sectoral services of the Ministry of Internal Affairs, Departments and divisions of Automobile Inspection, state bodies, enterprises, organizations and institutions, public associations whose activities are related to ensuring road safety and environmental protection.

4. The structure and staff of the State Automobile Inspection Department is approved by the Minister of Internal Affairs of the Republic of Tajikistan.

5. The head of the State Automobile Inspection Department and his deputies are appointed and dismissed by the Minister of Internal Affairs of the Republic of Tajikistan. The head of the State Automobile Inspection Department of the Ministry of Internal Affairs of the Republic of Tajikistan is considered to be the Chief State Motor Vehicle Inspector of the Republic of Tajikistan, and his deputies are considered to be the Deputy Chief State Motor Vehicle Inspector of the Republic of Tajikistan.

Heads of the State Motor Vehicle Inspectorate of the regions, cities and districts of the Republic of Tajikistan are, according to their duties, the state motor vehicle inspectors of the regions, cities and districts and their deputies, the deputy state motor vehicle inspectors of the regions, cities and districts of the Republic of Tajikistan.

6. The State Enterprise of the Republic of Specialized Assembly and Operation is subordinate to the State Automobile Inspection

Departments, sections and groups of the State Motor Vehicle Inspection of the Republic of Tajikistan are under the immediate jurisdiction of the Department of the State Automobile Inspection, the State Automobile Inspection of the districts, cities and districts of the Republic of Tajikistan.

According to the established procedure, other components can be organized in the State Automobile Inspection.

7. The State Automobile Inspection is a legal entity and has a seal with its name.

II. The main goals and tasks of the State Automobile Inspection Board

The main task of the State Automobile Inspection Department is to ensure the compliance with the requirements of the standards in the field of road traffic, which are related to its safety, as well as state control over compliance with the established standards of toxic emissions into the air and the noise level established for vehicles.

8. In the course of performing the tasks assigned to it, the traffic police Board:

Within the scope of his authority, he directs the lower bodies of the traffic police and supervises their activities;

prepare draft orders, regulations, instructions and other normative acts on issues related to the activities of the State Automobile Inspection, participate in the development of legislative acts, rules, norms, standards related to road safety and environmental protection, and monitor their implementation takes;

supervises the activities of ministries, departments, enterprises, institutions and organizations, regardless of their ownership, as well as officials, citizens, in the implementation of the requirements of legislative acts and other normative acts related to the issues of road safety and environmental protection;

to the ministries on issues that fall within their jurisdiction, offices, enterprises, institutions and organizations, regardless of their form of ownership, on the elimination of violations and identified deficiencies in the direction of road traffic safety and compliance with regulations related to emissions into the air and the noise level established for vehicles, by determining the deadlines for providing information on the results of the measures taken, issuing orders for mandatory execution;

prepares proposals to improve road safety, improve legal regulations in the field of road traffic;

Together with the relevant organizations and scientific institutions, participates in determining the priority areas and areas of scientific research related to the issues of ensuring road traffic safety;

in accordance with the established procedure, participates in the work of international organizations and organizations of the Commonwealth of Nations on issues of road safety, development and implementation of activities resulting from the participation of the Republic of Tajikistan in international agreements and agreements with the Commonwealth of Nations on these issues;

organizes nationwide consultations, gatherings, seminars and conferences on the issues of road safety and environmental protection, the fight against crimes related to the use of motor vehicles, as well as the improvement of the activities of the State Motor Vehicle Inspection units, in accordance with the established procedure prepares comments and other materials;

Studies domestic and foreign experience of combating accidents in automobile transport summarizes and distributes it;

organizes the cooperation of devices and units of the State Automobile Inspection with other local internal affairs bodies to ensure road safety and environmental protection;

registration and analysis of traffic accidents, violations of the Traffic Rules, motor vehicles and motorcycles registered in accordance with the established procedure, the results of the operation of devices and units of the State Motor Vehicle Inspection;

summarizes the implementation of legislation on road safety and environmental protection related to road transport, takes measures for the correct implementation of this legislation and prepares proposals for its improvement;

monitors compliance with legality in the practical-administrative activity of the lower bodies of the traffic police and the work situation regarding the reception and registration of information related to crimes and violations of law;

supervises the investigative production of cases related to traffic accidents by the units and units of the State Automobile Inspection, as well as the pre-trial preparation of materials in protocol form;

using the forces and tools of the State Automobile Inspection, organizes and implements control over the movement of vehicles and pedestrians, detection and prevention of violations of the Rules of traffic and environmental protection;

control over the maintenance of highways, streets, road structures and railway crossings, their compliance with safety conditions, equipping streets and roads with technical means of traffic regulation, placing outdoor advertising on vehicles and streets and roads, fulfilling the requirements organizes road traffic safety during repair and construction works on streets and roads, as well as at railway crossings;

organizes control over the observance of rules, norms and standards during the design, construction of roads and streets on ensuring road traffic safety, participates in their adoption and use, and gives conclusions based on the study of construction and reconstruction projects of highways of national importance ;

organizes and selectively conducts comprehensive inspection of the technical condition and maintenance quality of highways, streets and railway crossings, takes measures to improve traffic conditions in them;

organizes control over the technical condition of motor vehicles and motorcycles, as well as their state technical inspection;

control over the observance of norms and standards related to the safety of vehicles, as well as the standards for emissions of substances harmful to the air and the noise level established for vehicles, at what level is the preparation of the order and technical conditions, testing and acceptance of samples of vehicles organizes industrial production;

approval of types of re-equipment of vehicles is carried out after the conclusion of the technical commission of the Department of the Ministry of Internal Affairs and Communications of the Republic of Tajikistan regarding its impact on road traffic safety.

implements the procedure for granting the right to drive vehicles and ensures its control;

prepares samples of state registration marks, forms of vehicle registration certificates, driving documents, invoices and other final report forms and submits them for approval, allowing their production;

carries out legal promotion activities in the direction of road traffic safety and public safety in motor transport, including, using mass media, visual and verbal agitation;

organizes the cooperation of the State Automobile Inspection with ministries, state committees, offices, enterprises and organizations, regardless of their ownership, on issues of preventing traffic accidents involving children and adolescents;

provides paid services to enterprises, institutions, organizations, regardless of their ownership and individuals, related to the activity of ensuring traffic safety on the roads, except in special cases;

together with the Department of Personnel and Work with the personnel of the Ministry of Internal Affairs of the Republic of Tajikistan, studies the issue of the need for personnel in the units  of the State Automobile Inspection, organizes professional training courses and improvement of their skills;

prepares proposals for determining staff units and the structure of units and division of the State Automobile Inspection, accepts and deploys personnel of the traffic police and its subordinate units;

analyzes the state of educational-individual work in places and develops measures to improve these works;

organizes open and secret inspections on the service, observance of discipline and legality in the devices and units of the State Automobile Inspection, implements other measures to strengthen discipline and legality;

reviews letters, complaints and applications of individuals and legal entities on the issues of ensuring road traffic safety, as well as related to the activity of State Automobile Inspection units and units, monitors their timely and qualitative review, takes measures to eliminate the shortcomings mentioned in the letters ;

take tests on traffic rules and vehicle driving skills and issue driver's licenses for driving vehicles;

registers motor vehicles, motorcycles and their accessories and gives them documents and state registration marks;

participates in the protection of public order and the fight against crime;

together with other services of the internal affairs bodies, carries out the tasks of investigators on searching for drivers who have disappeared from the places of traffic accidents and stolen and hijacked vehicles;

organizes and carries out escorting of vehicles according to the established procedure, including on the basis of contracts;

regularly prepares the list of paid services of the State Automobile Inspection, the standard tariff for this type of service and agrees with the competent authorities;

organizes and implements the audit of the economic and financial activities of the lower units;

III. Basics of organization of State Automobile Inspection activity

9. The activity of the State Automobile Inspection is organized on the basis of single-mindedness in solving the issues of leadership over the service, by establishing the personal responsibility of each employee, over the state of work, in his assigned area and the performance of certain tasks;

10. The foundations of the organization of the activities of the State Automobile Inspection, the republican programs for ensuring public safety and road safety, current plans and prospects of the Ministry of Internal Affairs of the Republic of Tajikistan;

The work plans of the structural units of the State Automobile Inspection are approved by the head of the State Automobile Inspection, or their deputies, after they have been submitted by the heads of these units;

11. Documentation is carried out in the State Automobile Inspection independently on the basis of regulatory acts of the Ministry of Internal Affairs of the Republic of Tajikistan; 

IV. Rights and responsibilities of the Head of the State Automobile Inspection Department.

12. The head of the State Automobile Inspection Depatment is personally responsible for organizing the activities of the State Automobile Inspection, performing the tasks assigned to the State Automobile Inspection, and determines the level of responsibility of his deputies, as well as the duties of departments, sections and other structural units of the State Automobile Inspection Depatment.

13. The head of the Department State Automobile Inspection represents the Ministry of Internal Affairs of the Republic of Tajikistan in the work of international organizations and other organizations and institutions, meetings on road safety issues, according to the established procedure.

14. The head of the State Automobile Inspection Department has the right to:

issue orders, orders, comments, issue mandatory methodological instructions on the issues of the operation of the apparatus and units of the State Automobile Inspection, materials and information from the criminal investigation Department, the DMIA of the districts, cities and regions of the republic.

to request the necessary for the resolution of issues that fall under the authority of the State Automobile Inspection;

to cancel the orders and instructions given by the heads of the lower units, which contradict the legislation and documentation of the Ministry of Internal Affairs of the Republic of Tajikistan, as well as this Regulation;

approve documents, use funds allocated to the State Automobile Inspection and valuable materials available in the State Automobile Inspection Department, conclude contracts, issue authorizations;

According to the established procedure, write off the valuable materials belonging to the fixed assets;

within the scope of his rights, make a decision on the damage caused, shortage (deficiency), loss of valuable materials and monetary funds, and submit proposals to the leadership of the MIA of the Republic of Tajikistan on these issues;

distribute funds from budget funds and funds received from paid services allocated according to the cost estimate.

send employees of the State Automobile Inspection Department and subordinate units on business trips in the territory of the Republic of Tajikistan and offer them work leave;

in accordance with the disciplinary regulations of internal affairs bodies and labor legislation, to prepare proposals for awarding the management team and employees of the State Automobile Inspection Department, devices and subordinate units of the State Automobile Inspection Department.

to present recommendations to the leadership of the Ministry of Internal Affairs of the Republic of Tajikistan for awarding the employees of the State Automobile Inspection Department with State awards, who have shown merit in the performance of their official duties;

to present recommendations to the leadership of the Ministry of Internal Affairs of the Republic of Tajikistan regarding the awarding of badges and awards to the employees of the State Automobile Inspection Department and citizens;

fully implement the disciplinary measures provided by the legislation of the Republic of Tajikistan, orders and instructions of the Ministry of Internal Affairs of the Republic of Tajikistan.

Determined, apply to the staff of the Board and directly subordinate units of the Board;

to prepare proposals for the attestation of staff of the Department and subordinate units of the State Automobile Inspection Department;

to award junior and junior management staff with special ranks, as well as to send proposals to the Minister of Internal Affairs of the Republic of Tajikistan for awarding middle and senior management staff with special ranks;

to determine the criteria for counting, the procedure for establishment, reorganization and liquidation of the units that are maintained at the expense of the funds of the State Automobile Inspection Department;

to send proposals to the Ministry of Internal Affairs of the Republic of Tajikistan for approval of the Regulations and the structure of the staff of the structural units subordinate to the State Automobile Inspection Department;

to appoint and dismiss senior and junior management staff of the State Automobile Inspection Department and its directly subordinate units;

to submit candidates for the positions of the middle and senior management staff of the Board of the State Automobile Inspection and directly subordinate units, as well as the personnel of the registration and examination units of the State Automobile Inspection  criminal investigation department  of the regions for appointment and dismissal to the Minister of Internal Affairs;

agreed with the head of the State Automobile Inspection Department:

the proposal of the head of the DMIA of the Republic of Tajikistan on the appointment and dismissal of the heads of the DIA and their deputies, the heads of the DIA State Automobile Inspection departments, the heads of the DIA State Automobile Inspection departments of the districts of Dushanbe, cities and regions of the regions, the commanders of the guiding service company of the DIA of Dushanbe, Regions and their deputies;

submission of the heads of the Ministry of Internal Affairs of the Republic of Tajikistan to the Ministry of Internal Affairs of the Republic of Tajikistan on the appointment and dismissal of the personnel of the department and groups of the Ministry of Internal Affairs of the Republic of Tajikistan;

proposal of the heads of the traffic police department DIA of Dushanbe city, regions on the appointment and dismissal by order of the head of the DIA the personal staff of the rank, junior, middle and senior leaders of the DIA.

Acceptance of candidates for service and appointment of employees to the State Automobile Inspection department’s authorities of Dushanbe city, of cities and districts of the republic is carried out after they have passed the central selection commission of the State Automobile Inspection departments, chaired by the head of the State Automobile Inspection departments.

Acceptance of candidates for service and appointment of employees to of State Automobile Inspection departments DIA bodies of regions is carried out after they pass through the selection commission of State Automobile Inspection departments DIA regional departments, whose management is entrusted to the responsible employees of the State Automobile Inspection departments.

V. Financial support

15. The activities of the Department of State Automobile Inspection of the Ministry of Internal Affairs of the Republic of Tajikistan in terms of financial and material-technical support are carried out at the expense of the following funds:

republican budget;

local budget;

funds of ministries, departments and enterprises;

fundraising of insurance organizations;

funds received from economic activity and paid services of BDA;

funds received by legal and natural persons.
